Our Borrower and Non-Purchasing Entity Signature/Name Affidavits (Cx865 and Cx7965, respectively) are not required by law, but are provided as a way to prevent any future litigation arising over the identity of the borrowers. These documents are sworn statements, which, in New York, requires jurat language rather than acknowledgement language. Pursuant to NY Executive Law § 137 and NY Department of State: Notary Public License Law (June 2016), p.15., we are modifying the NY notary language on Cx865 and Cx7965 to follow the form provided by statute. Additionally, we have added “subscribed” to the language to signify that the person signing is also being acknowledged.
