Global Mapping Changes: Two Community Property State Fields

Pursuant to a compliance review, we are updating the mappings for two fields that are associated with community property states. The first, “Property is in Community Property State” (Field 131699), is used to trigger a corresponding checkbox on the redesigned FNMA 1003 labeled: “The property is in a community property state.” The existing global field value mapping on “Property is in Community Property State” has been modified to add Wisconsin. By default, field 131699 will be set to “Yes” if:

• Property is in Community Property State is not already set, and
• Property State (Field 1714) is one of the following:
  • Arizona
  • California
  • Idaho
  • Louisiana
  • Nevada
  • New Mexico
  • Texas
  • Washington
  • Wisconsin

The second, “Borrower Resides in Community Property State” (Field 103791), is used to trigger a corresponding checkbox on the redesigned FNMA 1003 labeled: “At least one borrower lives in a community property state.” A new global field value mapping has been added to “Borrower Resides in Community Property State”. By default, field 103791 will be set to “Yes” if:

• Borrower Resides in Community Property State is not already set, and
• Borrower 1 Present Address: State (Field 27239), Borrower 2 Present Address: State (Field 24705), Borrower 3 Present Address: State (Field 25691), or Borrower 4 Present Address: State (Field 26668) is set to one of the following:
  • Arizona
  • California
  • Idaho
  • Louisiana
  • Nevada
  • New Mexico
  • Texas
  • Washington
  • Wisconsin

Note that we have not set Alaska as a community property state, even though Alaska is considered an “opt-in” community property state, which means that property can be treated as community property. According to Alaska Statute 34.77.030, property may be classified as community property, but only through a written community property agreement. For these two fields, Alaska needs to be addressed with custom changes to the community property mappings, or the field values can be imported as needed.
