Document Updates: New Hampshire Notarial Requirements for RON

New Hampshire Senate Bill 134 enacts the Revised Uniform Law on Notarial Acts, including provisions for notarizations on electronic records and for remotely located individuals which take effect on February 6, 2022. Amongst other changes, this amends N.H. Rev. Stat. Ann. § 456-B, by inserting after Section 6 the following new § 456-B:6-a for Notarial Act Performed for Remotely Located Individuals. Pursuant to the newly created § 456-B:6-a(V)(b) for remotely located notarial acts we have updated the short forms to include the sentence “This notarial act involved the use of communication technology.” This will now print in the notary sections of the following standard New Hampshire mortgages when applicable:

  • NH Mortgage (Cx339)
  • FHA NH Mortgage (Cx19387)
  • NH Mortgage Second (Cx497)
  • HELOC Mortgage – NH (Cx1330)

The following multi-state documents have also been changed for New Hampshire:

  • Compliance Agreement (Cx4)
  • Occupancy Statement (Cx15)
  • Manufactured Home Affixation Affidavit (Cx43)
  • Manufactured Home Limited Power of Attorney (Cx6874)
  • Signature/Name Affidavit (Cx865)
  • Signature/Name Affidavit (NPE) (Cx7965)
  • Loan Modification Agreement – Fixed (Cx1701)
  • Loan Modification Agreement – ARM (Cx4888)
  • Loan Modification Agreement – ARM (Cx10514)
  • Loan Modification Agreement – Fixed (Cx10515)
  • HomeStyle Renovation Loan Rider (Cx22294)
  • HomeStyle Renovation Loan Agreement (Cx22295)
  • FNMA Construction Loan Agreement (Cx22651)
  • FNMA Construction Loan Rider to Security Instrument (Cx22653)
  • Community Land Trust Ground Lease Rider (Cx23607)
