Inst., § 5-514(c) & § 6-606.1(c). Since we chose to follow the most conservative interpretation to provide disclosures before collecting the six pieces of information that constitute an application under Regulation Z, this meant that: 1) the generic print configurations were set very broadly to encompass any type of loan because the actual loan type might not be known before collecting the six pieces of information; and 2) the Maryland version of Cx28523 “State Assumption Notice” was set to print in Pre-Disclosure Packages. After the Maryland Office of Financial Regulation (OFR) issued guidance clarifying that it was acceptable to provide disclosures within three business days of receiving a completed application, as defined in 12 CFR §1026.2(a)(3), we added the Maryland version of Cx28523 “State Assumption Notice” to Initial Disclosure Packages as well. After further review of the definitions of “conventional home mortgage loan” in MD Code, Fin. Inst., § 11-501(b-1) and “dwelling” in MD Code, Fin. Inst., § 11-501(c), we have updated the Maryland divorce assumption generic print configurations as follows: **Maryland Version of State Assumption Notice (Cx28523):** Print State Assumption Notice (FI 193824) is now globally standard value mapped to "Yes" for Maryland to print the State Assumption Notice when: - Occupancy is not Investment **(new condition)**; - Loan Type is not FHA, VA, or RD **(new condition)**; - Apply Exemption to State Assumption Upon Decree of Absolute Divorce (FI 193924) is not "Yes"; and - Document Package Type is Pre-Disclosure or Initial Disclosure.   **Maryland Security Instruments:** The "Assumption upon Decree of Absolute Divorce" paragraph will now print in Maryland security instruments when: - Occupancy is not Investment **(new condition)**; - Loan Type is not VA or RD (Cx25299 only); and - Apply Exemption to State Assumption Upon Decree of Absolute Divorce (FI 193924) is not "Yes". The foregoing applies to the following Maryland security instruments: - 3021 MD Deed of Trust 2021 (Cx25299) - MD Deed of Trust Second (Cx487) - HELOC Deed of Trust - MD (Cx3040)   **Maryland & Virginia LE/CD Assumption Disclosure – Assumable Loan (FI 1170):** In accordance with the [**CFPB’s Official Interpretation of Regulation Z § 1026.37(m)(2)**](https://www.consumerfinance.gov/rules-policy/regulations/1026/interp-37/#37-m-2), the specific global standard value mappings for Maryland and Virginia relating to Field 1170 “Assumable Loan” have been removed. The LE/CD assumption disclosure addresses whether a third-party may assume the loan on its original terms if the property is sold or transferred. The applicable Maryland and Virginia provisions address certain transfers between existing borrowers following divorce or separation. Accordingly, those state provisions will no longer, by themselves, cause Field 1170 to be mapped to “Yes.” These changes are available for testing on Stage & Stage 2 servers and will take effect on October 29, 2026.
