Minnesota Statute § 47.20, Subdivision 8 requires that conventional mortgage documents include a provision obligating the lender to provide written notice of default to the borrower prior to initiating foreclosure. This notice must be sent via certified mail to the property address or another address which is designated in writing by the borrower.

Docutech’s Fannie Mae Form 3024 Minnesota Mortgage (Cx25302) already includes language in Section 12 that explicitly permits electronic communication for such notices. However, it was recently brought to our attention that the Minnesota Mortgage Second (Cx490) did not contain similar language allowing for electronic delivery.

To align our Minnesota documents and ensure consistency across our library, we have updated the Notice provision in Section 12 of Cx490 to match the language found in Cx25302. This change supports lenders who prefer to utilize electronic communication methods while maintaining compliance with Minnesota foreclosure notice requirements.
