Document Update: MT Acknowledgment that Real Property is Not Exempt From Execution (Cx1412)

We have historically provided the MT Acknowledgment that Real Property is Not Exempt from Execution (Cx1412) based on provisions in the Montana Code that required such an acknowledgment.
The statutory provision requiring a declaration that real property is not exempt from execution was repealed many years ago (2001 Mont. Laws, Ch. 30, § 5). Despite this repeal, we continued to provide Cx1412 because the form was customary and considered beneficial by many clients.
Because there is no longer a statutory requirement for this acknowledgment, Cx1412 will be retired as a standard document. The form will remain available upon client request as a custom document.
