We have modified the cover letter of the Social Security Number Verification (Cx5579) to include a consent to eSign in order to comply with the eCBSV user agreement instructions. The consent to eSign will be found on the bottom of the cover letter and reads:
“By clicking the I ACCEPT button, you are signing the consent for SSA to disclose your SSN verification to [“Company Name:” data from the SSA-89]. You agree that your electronic signature has the same legal meaning, validity and effect as your handwritten signature.”
Following this wording will appear the options to accept or decline. If “I accept” is selected, the user will be required to eSign the document. If decline is selected, the user will not be able to eSign and will have to ink sign instead.
The eCBSV user agreement, Section IV E (2) states that for the Social Security Number Verification document, “The Electronic Signature must be executed or adopted by a person with the intent to sign. It must be clear to the SSN Holder, either in the Written Consent or elsewhere in the signing process, that he or she is signing SSA’s Written Consent.” We believe that the addition of this wording on the cover letter satisfies these requirements.
The new eSign consent text and will appear on the SSA-89 coversheet and trigger the eSign prompts when new field “Prompt for eSign on SSA-89” (FI 154581) is set to “Yes”. This functionality will only trigger when eSign has been selected for the distribution method, which sets “eSignature” (FI 28858) to “Yes”. Cx5579 will continue to be ink sign by default.
