NY adopted Senate Bill 1780C and Senate Bill 7780 which permit remote notarizations and updates NY executive law on electronic notarization. The executive law was amended by Bill 1780 by adding a new section 137-a, and Bill 7780 amended the executive law by adding section 135-C.
Senate Bill 1780:
Senate Bill 1780 was signed in December of 2021 and allows for notarization to be done electronically with the use of video technology.
Section 1 amends the executive law by adding the new section to N.Y. Exec. Law § 137-a. The bill establishes new definitions and requirements for electronic notaries. Specifically updating the definition for electronic notarization to include remote online notarization. It also sets forth the form and manner of electronic notaries. Which now reflects that (1) the Notary must use an electronic signature, (2) The remote online notarial certificate for an electronic notarial act shall state, “This remote notarial act involved the use of communication technology.” Section 3 sets the effective date as June 20, 2022.
Senate Bill 7780:
NY adopted SB 7780 in Feb 2022, to amend the executive law by adding a new section 135-c. SB 7780 is established in relation to providing for electronic notarization and to amend a chapter of the laws of 2021 amending the executive law relating to providing for electronic notarization, as proposed in legislative bills numbers S. 1780-c and A. 399-b.
