Document Update: Fannie Mae Updates MERS Lender Definition in 07/2021 Texas Home Equity Security Instrument Form 3044.1 (Cx25323)

Fannie Mae recently updated Paragraph 4(a) of the Instructions to the 07/2021 Texas Home Equity Security Instrument (Form 3044.1) (our Cx25323).

In this Instruction update, if MERS is designated as the mortgagee of record (as nominee for the beneficiary), the following change will occur:

The fourth sentence of the definition of “Lender” that reads, “Lender is the beneficiary under this Security Instrument.” will be deleted and replaced with the sentence, “Lender includes any holder of the Note who is entitled to receive payments under the Note.”

In order to access the updated version of Cx25323 – 3044.1 TX Home Equity Deed of Trust 2021 on Production servers before the mandated usage date of January 1, 2023, clients will need to individually map field “Use New FNMA/FHLMC Legal Documents (07/2021)” (FI 152151) to “Yes”. On January 1, 2023, field “Use New FNMA/FHLMC Legal Documents (07/2021)” (FI 152151) will be globally mapped to “Yes”.

The updated version of Cx25323 – 3044.1 TX Home Equity Deed of Trust 2021 will be available for use on Production servers immediately. If you have any questions or concerns, please contact Client Support at 1.800.497.3584.
