Document Update: Fannie Mae Updates Notice of Default Paragraph in 07/2021 District of Columbia Security Instrument Form 3009 (Cx25287)

On June 28, 2023, Fannie Mae announced that the Model Form for the District of Columbia Deed of Trust (Form 3009) has been revised to increase clarity in Paragraph 26(a) “Notice of Default”.

Paragraph 26(a) has been updated as follows:

1. The phrase “and, to the extent available under Applicable Law” has been added to the end of Section (iv);
2. The words “preforeclosure” now appear as “pre-foreclosure” in Section (v); and
3. Section (vii) regarding “any other information required by Applicable Law” has been removed entirely.

These changes in Cx25287 – 3009 DC Deed of Trust 2021 will take effect on July 14, 2023. If you have any questions or concerns, please contact Client Support at 1.800.497.3584.
