Document updates: Cx19609 TX Homestead Affidavit

Written by Will Newsom | Dec 3, 2024 9:27:36 PM

Tex. Prop. Code Ann. § 41.0021 allows the homestead exemption for certain types of trusts, namely inter vivos revocable trusts.  The statute grants the homestead exemption when a settlor or beneficiary occupies and uses a property…and in which the settlor or beneficiary own a beneficial interest through a qualifying trust.  A “qualifying trust” is an express trust that is revocable, settlor or beneficiary uses the property as principal residence, and the title of the property has been moved to the trust. (see  Tex. Prop. Code Ann. § 41.0021 (a)).

Previously we did not support the ability for a trust to sign Cx19609.  We have updated the form so that a trustee can sign the document on behalf of the trust. We are also adding the ability for Non-Purchasing Entities to sign the document.  Logic will also be added to the notary section to include both Trust signors and NPE’s.

These changes are available for testing on Stage & Stage 2 servers and will be in effect on December 10, 2024. If you have any questions or concerns about these changes, please contact Client Support at 1.800.497.3584.
