Document Updates: Bolded “Prepayment Terms” Section in Enhanced Prepayment Fee Documents

Given that certain states and many investors require bolded text to emphasize the “prepayment terms” section of Enhanced Prepayment Fee documents, Docutech has decided to bold the “prepayment terms” text for all states regardless of whether or not there is a value in Field 38656 “Use State Specific Prepay Language”.

The “prepayment terms” section generally begins with:

“If I make a full or partial Prepayment within _____ months of the date of the Note . . .”

And, the “prepayment terms” section generally ends with:

“I will not be obligated to pay a Prepayment fee if such a charge violates state or federal law.”

As such, the following documents have been updated:

• Cx12388 Enhanced Prepayment Fee Rider
• Cx12389 Enhanced Prepayment Fee Disclosure
