In accordance with 215 ILCS 155/18, a “producer of title business” is required to “disclose to any party paying for the products or services the financial interest of the producer of title business or associate referring the title business and a disclosure of an estimate of those charges to be paid.”
As defined by 215 ILCS 155/3(4) a “producer of title business” refers to “any person, firm, partnership, association, corporation or other legal entity engaged in this State in the trade, business, occupation or profession of….(ii) making loans secured by interests in real property.”
This disclosure is required when the producer has any interest in the title, escrow, or title insurance agents.
The State of Illinois has a published form to comply with this disclosure requirement. We have created Cx28407 to align with the published form. Additionally, we have created FI 193699 “Print Disclosure of Financial Interest” to trigger this disclosure in Illinois initial and closing packages.
