In a continuing effort to improve notary processes, Docutech has updated the borrower notary acknowledgment and jurat blocks on several documents.
Notary Acknowledgment vs. Jurat
The purpose of a notary acknowledgment is to verify the identity of the signer and confirm that they voluntarily signed the document. Notary acknowledgments are commonly used on security instruments, powers of attorney, and disclosures.
The purpose of a jurat is to verify the identity of the signer AND require the signer to swear or affirm that the contents of the document are true. Jurats are commonly used on affidavits, declarations, and verifications.
Jurat Standardization Project
Previously, Docutech completed a project to standardize notary acknowledgment logic and text across various recordable documents. Docutech has now extended this project to jurat blocks. Jurat blocks have been thoroughly updated and audited for text and logic compared against current state statutes and regulations for Ink Sign, Remote Online Notary (RON), and In-Person Electronic Notary (IPEN). The standardized jurats will allow for documents to be adjusted more easily when statutes and regulations change and to streamline new document creation.

Standardization of Loan Modification Borrower Notary Acknowledgment
Docutech’s generic Loan Modification documents are based on Fannie Mae’s Fixed Loan Modification Agreement (FNMA Form 3179) and Fannie Mae’s ARM Loan Modification Agreement (FNMA Form 3161). To ensure consistency across document types, generic Loan Modification documents will now use the same borrower notary acknowledgment block code used in Docutech’s standard security instruments. This update has been made to the following documents:
Kansas and North Carolina Remote Online Notary Block Changes
Kansas
Kan. Admin. Regs. § 7-43-17(b) states:
When a notary public performs a notarial act for a remotely located individual, the notarial certificate shall contain a statement substantially as follows: “This notarial act involved the use of audiovisual communication technology.”
Per this instruction, the language in the Kansas RON acknowledgment now reads:
This instrument was acknowledged before me on ________, ______, by _________________________________________________________________.
This notarial act involved the use of audiovisual communication technology.
The Kansas RON jurat now reads:
Signed and sworn to (or affirmed) before me on this ______ day of ________, ______, by _________________________________________________________________.
This notarial act involved the use of audiovisual communication technology.
North Carolina
N.C. Gen. Stat. Ann. § 10B-134.1 states:
(7) Remote electronic notarial certificate.--The portion of a notarized electronic document that is completed by the electronic notary and contains all of the following:
