Document Updates: Tennessee and West Virginia Security Instrument Residency Logic (Various Documents)
Apr 3, 2026
Tennessee and West Virginia are trustee states that require the named trustee to be a resident of the state. See Tenn. Code Ann. § 66-24-1323 and W. Va. Code § 38-1A-2. Both jurisdictions permit disclosure of the trustee’s county of residence as sufficient to satisfy this requirement, consistent with FNMA model instruments.
We are implementing a refinement to the data population logic used for trustee residency disclosure on the security instrument:
This update is intended to ensure that a valid county-level residency disclosure is consistently included on the instrument, even when explicit trustee residency information is not provided.
The following instruments have been updated with the new logic:
Cx1389 – HELOC TN Deed of Trust
Cx25321 – 3043 TN Deed of Trust (2021)
Cx26160 – FHA TN Deed of Trust (2021)
Cx509 – TN Deed of Trust Second
Cx3045 – HELOC Deed of Trust – WV
This change is available for testing on Stage & Stage 2 servers and will take effect on April 10, 2026. If you have any questions or concerns about these changes, please contact Client Support at: 1.800.497.3584.
