One of the amendments to Regulation X included in 76 FR 40612 was to clarify that only charges actually provided or purchased should be listed on page 3 of the HUD-1 Settlement Statement.
Currently the Good Faith Estimate amount is being displayed in the HUD-1 comparison chart for the hardcoded rows (lines that always print in the chart) even if the fee was not actually charged at Closing.
Effective October 12, 2011, if a fee on one of the hardcoded rows in the comparison chart (801, 802, 803, 1203; 1201; 1001, 901, or 903) is not charged at Closing, then “N/A” will print in the “Good Faith Estimate” column instead of the GFE amount.
The ConformX tolerance calculations already exclude the GFE amounts for fees not charged at Closing and therefore do not require modification. Fee lines that are not hardcoded in the comparison chart will continue to only print if the fee was actually charged at Closing.
