Tex. Fin. Code §343.105 requires a lender, mortgage banker, or licensed mortgage broker to provide to each applicant for a home loan a written notice, with specific language, warning the applicants that making a false or misleading statement is punishable under Texas law.
Although the statute sets forth the specific language, the Texas Department of Banking has published a sample version of this notice that may be used to comply with §343.105. Continuing with its policy to provide government-approved model or sample disclosures, to ensure complete compliance with all laws and regulations, DocuTech will be adapting its version of the notice (Cx12309) to match the sample version provided by the Department of Banking.
This change will take affect Monday, October 17th, 2011.
