The ConformX Delaware security instruments and assignments will be modified to meet the different recording requirements for each of the three counties in Delaware.
The font size of the text in the body of the Delaware recordable documents will increase to 12 point for all counties. Previously only Sussex County was set to 12 point. The font size of both the footer text and loan identification information under the document title will change to 10 point for all counties.
Placement of the first page recording information will be modified to meet each county’s requirements. The “PIN”, “Prepared By”, and “When Recorded Mail To” sections will be triggered to print on the left hand side of the first page for Sussex County and Kent County. These same sections will continue to print on the right hand side of the first page for New Castle County. These sections will also move up to print directly below the one inch margin of the first page.
The Office of the Sussex County Recorder of Deeds advised that while they had not been enforcing payment in the past, starting in August they will begin imposing a $30.00 fee for each document that does not adhere to their recording requirements. When contacted, the Office stated they were concerned with margin requirements and they specifically requested that the first page recording information be placed in the upper left corner of the page. Regarding font size, they stated that although their website calls for 12 point type, they really just need clear copies for recording.
All standard ConformX security instrument riders are already in a clear font size (11 point font body text) and meet the margin requirements for Delaware and therefore did not need to be modified.
