2013 Oregon Laws ch. 219 (H.B. 2834) was passed this past year, which repealed the “Uniform Law on Notarial Acts” (Or. Rev. Stat. §§ 194.505 through 194.595) and enacted a new “Revised Uniform Law on Notarial Acts” (codification still pending).
This law, among other changes, revised (in Section 15) the short form notarial certificate, which we use on several documents which are generated for loans secured by property in Oregon. Most of these revisions are minor in nature, except that the certificate now references a notarial stamp rather than a notarial seal.
We will be updating the notary acknowledgment areas on the following documents, accordingly:
Cx4 (Compliance Agreement)
Cx15 (Occupancy Statement)
Cx43 (Manufactured Home Affixation Affidavit)
Cx865 (Signature/Name Affidavit)
Cx870 (Correction Agreement – Limited Power of Attorney)
Cx1546 (OR Assignment of Deed of Trust)
Cx4343 (OR Assignment from MERS)
Cx4489 (OR Assignment – INV BLANK)
Cx6874 (Manufactured Home Limited Power of Attorney)
Cx7965 (Signature/Name Affidavit [NPE])
Cx8909 (Occupancy Statement)
Cx11868 (OR Housing – Affidavit Addendum to Residential Loan Application)
Cx11869 (OR Housing – Addendum to Deed of Trust)
Cx11870 (OR Housing – Assignment of Deed of Trust)
Cx13232 (Affixation Affidavit)
Cx14139 (Lender’s Statement of Intent)
Cx16108 (OR FHA GNND Second Mortgage)
We will push out these changes as they are made, beginning Jan 22, 2014. If you have any questions or concerns about these changes, please contact Client Support at 1.800.497.3584.
