Cx3981 is a duplicate of form HUD-92900-A and VA Form 26-1802a, which are provided pursuant to the provisions of FHA ML 2008-15 and VA Lender’s Handbook ch. 3, 5-i and ch. 5, 4-c & 5-b.
Copies of these forms may be downloaded from either HUD’s website or the VA’s website. This form was recently updated to reflect the VA’s new policies concerning marriages (see VA Circ. 26-13-18 for an example). Cx3981 will be updated accordingly in the following ways:
- Two revision dates will be added to the form, one associated with the HUD form number (“09/2010”) and another for the VA form number (“06/2014”). Please note that on this point, the HUD and VA forms differ. We have decided to follow the format of the HUD form and include both revision dates, since this provides more information.
- The sentence, “This consent is valid for 180 days from the date signed, unless indicated otherwise by the individual(s) named in this loan application” in Part IV of the form will no longer print in bold.
- The following text will be placed between Clauses 23 and 24:
IMPORTANT: If you are certifying that your are married for the purpose of VA benefits, your marriage must be recognized by the place where you and/or your spouse resided at the time of marriage, or where you and/or your spouse resided when you filed your claim (or a later date when you become eligible for benefits) (38 U.S.C. § 103(c)). Additional guidance on when VA recognizes marriages is available at http://www.va.gov/opa/marriage/.”
