Cx1010 is provided pursuant to the provisions of Ga. Code Ann. § 48-7-128 and Ga. Comp. R. & Regs. r. 560-7-8-.34 & 560-7-8-.35, for the purpose of certifying the fact that the seller is exempt from the state’s withholding tax requirements which are applicable to cases where a nonresident seller conveys real property.
This document is a duplicate of Georgia Department of Revenue’s Form AFF3 (available at http://dor.georgia.gov/documents/aff3-sellers-certificate-exemption). We are updating our Cx1010 to match the latest version of Form AFF3.
Cx15037 is provided pursuant to Ga. Code Ann. § 48-6-69(a) for cases where the subject property of a mortgage loan is located in more than one county, in order to identify for each county the pro-rated amount of taxes they may collect on the property.
Because this document is recorded and because the holder of the security deed for the subject property is solemnly swearing to the facts contained in the affidavit, we will be including a jurat certificate following the holder’s signature lines. The jurat will be the same as the model “Georgia Jurat Certificate” published by the Georgia Superior Court Clerks’ Cooperative Authority (see https://www.gsccca.org/file/notary-forms).
