Our Signature/Name Affidavit (Cx865) is not required by law, but is provided as a way to prevent any future litigation arising over the identity of the borrowers. The Signature/Name Affidavit is given to each borrower individually to have them state that they are, “…the same person named in the Note and Security Instrument.” However, borrowers who are co-signing a loan do not typically sign the Security Instrument. Given this fact, we have decide to remove the words “and Security Instrument” for copies of the Signature/Name Affidavit intended to be signed by co-signers. This means that a co-signer who signs the Signature/Name Affidavit will certify that they are “…the same person named in the Note.”
Please note, however, that it is possible in ConformX to have the co-signers added to the signatures on the Security Instruments using the “Include Cosigner 1 on Signature Lines 1” (Field 80363) series. If one or more of these fields are set to “Yes,” then the phrase “and Security Instrument” will continue to print on the copy of the Signature/Name Affidavit intended for the corresponding borrower(s).
