To comply with Virginia Code Annotated § 58.1-802, we have added the following sentence to the first page of certain Virginia recording instruments:
“The amount of consideration for Virginia recording tax purposes is $_____.”
VA Code Ann. § 58.1-802 states in part:
“No such deed, instrument, or other writing shall be admitted to record unless (i) the amount of the consideration is stated on the first page of the document to be admitted to record and (ii) certification of the clerk of the court wherein first recorded has been affixed thereto that the tax imposed by this section has been paid. The clerk shall include within the certificate the amount of such tax collected thereon.” [Emphasis added]
The following documents were updated:
- VA Deed of Trust (Cx354)
- VA Deed of Trust Second (Cx512)
- FHA VA Deed of Trust (Cx19404)
On Cx512, we also removed the duplicate “Tax Map Reference #/Parcel I.D. # ________” as the parcel identification number (PIN) was already printing below and to the right of the title, as required by § 17.1-252.
