In July 2015, Ga. Code Ann. § 44-5-30 was revised to remove the requirement for an acknowledgment for certain real property instruments, but requires these documents to be “attested” by the Notary and signed by one other witness. With this in mind, and to more closely comply with Fannie Mae’s Georgia Uniform Instrument Form 3011, Docutech’s Georgia security instruments have been modified by: 1) adding the notary witness signature line and corresponding language underneath the attestation verbiage; 2) removing the notary acknowledgment; and 3) leaving “[Space Below This Line For Acknowledgment]” (even though an acknowledgment will no longer appear below) because it is a part of the Georgia Model Form 3011 template. The “[Space Below This Line For Acknowledgment]” language will remain in Docutech’s Georgia security instruments as long as Fannie Mae’s Georgia Uniform Instrument Form 3011 contains it.
The documents affected by this update are:
- GA Security Deed (Cx318)
- GA Deed of Trust Second (Cx477)
- HELOC Security Deed – GA (Cx1406)
- FHA GA Security Deed (Cx19368)
These document changes will be in effect on January 12, 2018. If you have any questions or concerns about these changes, please contact Client Support at 1.800.497.3584.
