Rural Development Form RD 410-9 “STATEMENT REQUIRED BY THE PRIVACY ACT” (Docutech’s Cx2862) contains a Federal Equal Credit Opportunity Act (ECOA) statement that includes an address for the agency which administers compliance with ECOA for Rural Development. This administering Federal agency is the Federal Trade Commission, which has an address on the document of: Federal Trade Commission, Pennsylvania Avenue at Sixth Street N. W., Washington, DC 20580.
However, 12 C.F.R. § 1002.9(b)(1) requires that the ECOA statement include the “name and address as specified by the appropriate agency or agencies listed in Appendix A of this part”. Rural Development falls under the address listed in App. A(9), which is the “FTC Regional Office for region in which the creditor operates or Federal Trade Commission, Equal Credit Opportunity, Washington, DC 20580.” Since Rural Development operates nationwide, the correct address is the national address.
Consequently, we will be changing the “Pennsylvania Avenue at Sixth Street N. W.” portion of the address on Cx2862 to “Equal Credit Opportunity” in order to comply with 12 C.F.R. § Pt. 1002, App. A(9).
