Louisiana Civil Code CC 3352(A)(2) requires that, to be recorded, an instrument shall contain “the marital status of all of the parties who are individuals, including the full name of the present spouse or a declaration that the party is unmarried.” (Note, however, that CC 3352(B) says that a recorder “shall not refuse to record an instrument because it does not contain the information required by [subsection A].”)
In order to comply more fully with subsection (A)(2), the logic on our LA Security Instruments is being modified to include the marital status of all non-purchasing entities that have a security interest in the property. In addition, the marital status can be disclosed as “not applicable” for those borrowers or NPEs that can’t have a marital status, such as trusts or corporations. The fields utilized include the Borrower Marital Status fields (FI 23681, 24654, 25640, and 26617) and the Non-Purchasing Entity Marital Status fields (FI 33758, 33760, 33762, and 33764). This change has been made to the following generic Security Instruments:
- LA Mortgage (Cx327)
- LA Mortgage Second (Cx485)
- FHA LA Mortgage (Cx19376)
