As previously announced, Ind. Code Ann. § 26-1-9.1-521 has been amended to require that “a filing office that accepts written records may not refuse to accept a written document for a filing by this chapter if the document conforms to a format that is: (1) approved by the International Association of Commercial Administrators . . .”, thus permitting creditors to use the standard IACA versions of the Uniform Commercial Code (“UCC”) forms (available at: https://www.iaca.org/secured-transactions/forms/) in lieu of the Indiana Secretary of State’s versions of these forms (available at: http://www.in.gov/sos/business/4051.htm).
In order to streamline maintenance processes, we will be configuring our copies of the IACA versions of the forms to print for cooperative loans in Indiana and will be “retiring” our copies of Indiana’s versions of the forms. To do so, we will be adding the condition “State Code = Indiana” to print Condition 1 of the following documents:
- UCC Financing Statement (Cx7700)
- UCC-3 Financing Statement (Cx22755)
- UCC-3 Financing Statement from MERS (Cx22778)
The following documents will be available to print on an “upon request” basis for any clients who wish to use them instead of the IACA version of the forms, but they will no longer be considered standard documents and will not be maintained for compliance:
- IN UCC-1 Financing Statement (Cx22852)
- IN UCC-3 Financing Statement Amendment (Cx22853)
- IN UCC-3 Financing Statement from MERS (Cx22858)
