Our Cx13513 is a duplicate of form HUD-92900-LT, which is required by no fewer than fifteen parts of FHA Single Family Handbook 4000.1 (see our “FHA Disclosure Matrix” for details). A copy of the form can be downloaded from HUD’s website (https://www.hud.gov/program_offices/administration/hudclips/forms/hud9).
HUD’s copy of the form has recently been updated; however, such copy appears to have formatting issues (e.g., underwriter’s signature line appearing close to the top of the form, the footer appearing in the middle page of the form, the third page only having a footer, etc.) and, after a comparison of this copy with the one most recently approved by the Office of Management and Budget (see https://www.reginfo.gov/public/do/PRAViewICR?ref_nbr=201808-2502-001), we believe these formatting issues to be unintentional and in error.
We will, therefore, be updating Cx13513 to match the latest copy published on HUD’s website, but will retain the form’s previous formatting. Changes we will make are as follows:
- Changing the OMB expiration date from “(03/31/2019)” to “09/30/2022)”);
- Inserting the following sentences (formatted in bold) into the first paragraph on the second page (between the two sentences ending and beginning with “the Privacy Act”):
“HUD is committed to protecting the privacy of individuals’ information stored electronically or in paper form, in accordance with federal privacy laws, guidance, and best practices. HUD expects its third-part business partners, who collect, use, maintain, or disseminate HUD Information to protect the privacy of that information in accordance with applicable law.”;
- Underlining the clause “substantial harm, embarrassment, inconvenience, or unfairness to any individual on whom the information is maintained” in the aforementioned paragraph, as well as removing the bottom-line separator from such paragraph; and
- Fixing a typographical error in the “Qualifying Rate” row of the “Mortgage Information” section of the form.
If HUD releases an updated/corrected 92900-LT Form, we will make further appropriate changes at that time.
