Document Updates: Massachusetts Mortgage Documents

Feedback from different counties in Massachusetts shows that they are expecting the notary to identify which type of identification was used in identifying the signer, in accordance with the general notary statute found in Mass. Gen. Laws Ann 183, App., Form (13). First American Docutech’s policy has been to use the notary block over the general notary if there is a notary block that is specific to real property. However, the real property notary block does not have a section that identifies the type of identification the signer uses. First American Doctuech is adding a field (“Security Instrument Notary Identification Produced”, Field 137250) to the real property notary block that allows the notary to specify which type of identification was used.

The documents that are being updated are as follows:

    • MA Mortgage (Cx328)
    • MA Mortgage Second (Cx486)
    • HELOC Mortgage – MA (Cx1332)
    • FHA MA Mortgage (Cx19379)
