Document Update: MT Acknowledgment that Real Property is Not Exempt From Execution (Cx1412)

As previously announced, Governor Jim Justice of West Virginia, signed into law WV S.B. 469 (2021) which permits Remote Online Notarizations (RON). The law requires that when using RON, the notary must indicate that RON was used. Accordingly, the following statement has been added to various documents: “This notarial act involved the use of communication technology.” The following state-specific documents have been modified to append this statement for RON loans:

- HELOC Deed of Trust – WV (Cx3045)
- FHA WV Deed of Trust (Cx19406)
In addition to the WV state-specific documents, the following multi-state documents have been changed for West Virginia:

- Loan Modification Agreement – Fixed (Cx10515)
- HomeStyle Renovation Loan Rider (Cx22294)
- HomeStyle Renovation Loan Agreement (Cx22295)
- FNMA Construction Loan Agreement (Cx22651)
- FNMA Construction Loan Rider to Security Instrument (Cx22653)
