Document Update: MT Acknowledgment that Real Property is Not Exempt From Execution (Cx1412)

One of the more unique state disclosures is the DC Mortgage Disclosure Form. What makes this disclosure so different is the requirement that when it is printed on a physical piece of paper it must be printed on red paper. D.C. Code Ann. § 26-1113(8)(C). Because the red paper requirement only applies when the disclosure is printed on a physical piece of paper, we are modifying the cover sheet that prints before the disclosure on our DC Mortgage Disclosure Form (Cx13354).
The cover sheet will now state:
“According to D.C. Code Ann. § 1113(a-1)(3) and (8)(C), if the following “Mortgage Disclosure Form” is given to the borrower on a physical piece of paper, it MUST be printed on a single page, front and back, red piece of paper measuring 8.5 by 11 inches.
Cx13354 is provided for informational purposes only. Use of this form, on a physical piece of paper, in a format other than as stated above will cause you to be out of compliance with District of Columbia law.”
These edits are being made to clarify that the red paper requirement only applies when the disclosure is provided on a physical piece of paper.

Update: Upon further review and to more closely match the statutory model language, we are slightly modifying the first sentence in the box starting with “WARNING:” to include the text: “(including taxes and insurance)” at the end of the sentence. The sentence will now read:
“WARNING: Industry standards suggest that a homeowner should spend no more than 28% of his or her gross monthly income on mortgage costs (including taxes and insurance).”
