Document Update: MT Acknowledgment that Real Property is Not Exempt From Execution (Cx1412)

Pursuant to a routine audit, we are adding witness fields to our standard Florida security instruments. According to Fla. Stat. Ann. § 695.26(1)(c), in order for an instrument affecting the title to real property to be recorded, it must include “the name of each witness to the instrument [to be] legibly printed, typewritten, or stamped upon such instrument immediately beneath the signature of such witness[.]” Accordingly, Docutech is adding fields (FI 15416 “Witness 1 Full Name” and FI 15417 “Witness 2 Full Name”) so that clients can send the witness name in their LOS payload and have it automatically populate on the security instrument.

Update: We have also added lines for witnesses to print their name on, underneath their signature, if the Witness Name fields are not populated. This change will be in effect immediately.
