For those circumstances where the borrower or non-borrowing party have an individual with power of attorney signing for them, we are updating our Signature/Name Affidavits (Cx865 & Cx7965) to provide additional clarity around which party the person with power of attorney is signing for, specifically the borrower or non-borrowing party.
On Cx865, our Signature/Name Affidavit (Borrower), we are inserting: “[borrower name], who is” to the first sentence. For borrowers with a POA it now reads, “I, the undersigned, state that I am the attorney in fact for [borrower name], who is the person named in the Note and Security Instrument.”
On Cx7965, our Signature/Name Affidavit (Non-borrowing party), we are adding the non-borrowing party name underneath the borrower’s name at the top of the page. In addition, for non-borrowing parties with a POA, we are editing the first sentence from: “I, the undersigned, state that I am the attorney in fact for the person named in the Security Instrument”, to: “I, the undersigned, state that I am the attorney in fact for [non-borrowing party name x], who is a person named in the Security Instrument.”
