As announced earlier, the new clean version of the 4506-C standard forms are available for eSign use in ConformX Production servers. The eSignature Behavior of the 4506-C Clean Version now has several layers and considerations. This PDF was created to help explain the different options:
Core eSignature Behavior
The core behavior of our eSign functionality is the same behavior as the previous version of the form. Though the default configuration setting for our copies of the 4506-C (Cx3095, Cx17841, and Cx18927) is set to ‘eSign’, clients can configure the document to be set to Ink Sign instead if desired. Since our copies of the 4506-C are already set to eSign, the existing core eSignature controls in the document code are enabled in the document (attestation checkbox, signatures, electronic signature confirmation checkbox). Note that this means if a client was already using eSign on the previous version of the form, no further actions are needed to add this core eSignature behavior to the new version.
Additional eSignature Behavior
All other layers of additional eSignature behavior are added on top of the core eSignature behavior. For example, it is best practice if Loan Origination Systems can send the new fields needed for the new version of the 4506-C; however, we recognize that may not be possible for some time. To accommodate situations such as these, we added several fields to allow various sections of the form to be electronically completed. These fields are as follows:
- FI 156026 “4506 eSign Behavior – Taxpayer Information (Sections 1 – 4)”
If this field is set to eSign, eSignature controls for the Borrower and (if applicable) Spouse to fill in data will be added to the Taxpayer Information (Sections 1 through 4 of the form).
- FI 156027 “4506 eSign Behavior – Recipient Information (Section 5)”
If this field is set to eSign, eSignature controls for the Lender (Loan Officer) to fill in will be added to the Recipient Information (Section 5 of the form).
- FI 156028 “4506 eSign Behavior – Request Information (Sections 6 – 8)”
If this field is set to eSign, eSignature controls for the Lender (Loan Officer) to fill in will be added to the Request Information (Sections 6 through 8 of the form).
- FI 156029 “4506 eSign Behavior – Signer Information (Signature Section)”
If this field is set to eSign, additional eSignature controls for the Borrower and (if applicable) Spouse to fill in will be added to the signature section of the form. Note that this field does not control the core eSignature behavior, only the additional behavior. Additional controls that are added when this field is ‘eSign’ are: Phone, Signed by Authorized Representative checkbox, Name, Title.
- FI 156025 “4506 eSign Behavior – All Sections”
If this field is set to eSign, eSignature controls will be added to ALL sections of the form. (Setting this field to eSign has the same effect as setting all four of the above fields to eSign.)
Please note that normally we would expect Sections 1 through 4 and the Signature area of the 4506-C to be filled out by the Borrower and (if applicable) the Spouse. Normally we would expect Sections 5 through 8 to be filled out by the Lender (Loan Officer).
The Instructions on page 2 of the 4506-C say, in part: “Form 4506-C must be signed and dated by the taxpayer listed on line 1a and, if listed, 2a.” This means that if any of the Spouse information is filled out, that spouse must sign the document. This is different from previous versions, where the Spouse did not always have to sign.
In addition, our system supports eSignatures for parties on the loan but does not currently support adding eSignatures for Spouses that are not on the loan. If the Spouse on the 4506-C is another Borrower on the loan, we can add an eSignature for that party so we will fill in the Spouse information and add eSignatures. However, if the Spouse on the 4506-C is not another party on the loan, we cannot add an eSignature for that signer so we will not fill in the Spouse sections of the form, even if the fields have values.
