Document Updates: Updates to Missouri Notary

Written by Tambree Knight | Aug 10, 2023 7:22:46 PM

After an in-depth review of Missouri notary law, specifically VAMS 486.600, it was noted that it makes more sense for notarial certificates on the Signature Name Affidavit (Cx865) to be jurats rather than acknowledgments. To be in better compliance with this statute, we have changed the notarial certificate from an acknowledgement to a jurat.

In addition, during COVID, many states enacted executive orders to allow for remote online notary (RON) and in person electronic notary (IPEN). Missouri was one of these states. When the executive order expired, Missouri codified provisions allowing for RON in VAMS 486.1175 and IPEN in VAMS 486.750. We have updated the Missouri version of the following documents to comply with these statutes:

Cx4 Compliance Agreement

Cx15 Occupancy Statement

Cx43 Manufactured Home Affixation Affidavit

Cx491 MO Deed of Trust Second

Cx865 Signature/Name Affidavit

Cx1355 HELOC Deed of Trust – MO
