According to Cal. Gov’t Code § 27321.5(b), the address of the trustor or one of the trustors is required to be on the deed of trust or mortgage. The language of the statute reads:
Every deed of trust or mortgage with power of sale upon real property, shall specify the address of the trustor or mortgagor, or if more than one, the address of any one of them, and shall contain a request by the trustor or mortgagor that a copy of any notice of default and a copy of any notice of sale thereunder shall be mailed to one trustor or mortgagor designated for the purpose of receiving such notice at the address so specified.
We are making some adjustments to the document code of several of our CA security instruments to designate which address will print. We will now determine if a specific borrower’s address passed in the payload, if one is not sent, then the logic will print the general security instrument borrower address on the security instrument.
The documents being updated are:
Cx1362 (HELOC Deed of Trust – CA)
Cx471 (CA Deed of Trust- Second)
Cx19362 (FHA CA Deed of Trust)
