On April 6, 2017 Gov. Susana Martinez (R-NM) signed into law H.B. 15 (2017), which implements a new “Data Breach Notification Act.” Among other provisions, this Act requires “a person that owns or licenses records containing personal identifying information of a New Mexico resident” to take certain precautions and actions to protect personal identifying information, including providing notifications to certain New Mexico residents when “personal identifying information is reasonably believed to have been subject to a security breach” (see https://www.nmlegis.gov/Legislation/Legislation?Chamber=H&LegType=B&LegNo=15&year=17). This Act will take effect on June 16, 2017.
