This document is provided to fulfill the provisions of Minn. Stat. Ann. §§ 580.032, 582.032, & 582.32 to record a request for notice of a mortgage foreclosure by advertisement, a reduced redemption period, or a voluntary foreclosure.
Currently, this document contains an area for entering the recording information for the mortgage upon which the filer requests notice. Since Minnesota law requires all documents submitted for recording to be assigned a document number (see Ibid. §§ 386.03, 386.04, & 386.31), we will be adding the caption “as Document Number” before the area (which will be replaced with Field 97269, “Security Instrument Recorded as Number”), in order to streamline the information needed to be inputted by clients. We will also be adding Field 6584 (“Security Instrument Recorded on Date”) before the caption.
In addition, we will be adding a “Draft By” section, promulgating the name and contact information of the person who drafted the document (using “PreparedBy” Fields 22820 and 22814 through 22819). While Minnesota law does stipulate that “no instrument by which the title to real estate or any interest or lien thereon, is conveyed, created, encumbered, assigned or otherwise disposed of, shall be recorded . . . until the name and address of the person who or corporation which drafted the instrument is printed, typewritten, stamped or written on it in a legible manner,” (Ibid. § 507.091[1]) Cx18225 is NOT such an instrument, as it does not convey title, but requests notification of certain events.
However, many of Minnesota’s county recorder websites indicate that they expect to see this section on all documents filed for recording (see http://claycountymn.gov/612/Recording-Requirements, http://www.co.cass.mn.us/government/county_directory/recorder/legal_recording_requirements.php, https://www.co.washington.mn.us/1325/Recording-Requirements, and https://www.ramseycounty.us/residents/property/recorders-office). Since there is no harm in having this section added when it is not required – and doing so will help prevent the document from needlessly being rejected by any recording office – we will be adding it to the very end of Cx18225.
