After a standard review, we are modifying the language that prints on two of our second lien DOT Security Instruments in Virginia (Cx512) and Nebraska (Cx496) to match the language of the first lien Security Instruments published by FNMA.
On both second lien documents, under “NON-UNIFORM COVENANTS. Borrower and Lender further covenant and agree as follows:”, the final sentence in the 3rd paragraph that prints after “Trustee shall apply the proceeds of the sale in the following order:” is being modified by removing the specific percentage amount that prints in “Trustee’s fees amount of____%” and replacing it with language “including a reasonable commission to trustee;” (on Cx512) and “including the payment of the Trustee’s fees actually incurred” (on Cx496).
