As part of our review of State-specific documents to support new “simultaneous broker document” packages, we will be making changes to certain State-specific copies of our Anti-Coercion Insurance Disclosures (Cx2778 & Cx2788), to conform the language of the forms closer to that of State law, as well as to use broader terms in identifying who the anti-coercion provisions apply to. These changes will apply regardless of what package the documents print in and are as follows:
- Anti-Coercion Insurance Disclosure (Cx2778), Colorado Version: The first paragraph, which is provided due to Colo. Rev. Stat. Ann. §§ 10-2-602 & 10-3-1105, will be modified by generally changing most references from “the lender” to “a person” – effectively stating that no person may unreasonably disapprove of the borrower’s choice of insurer.
The narrative of the second paragraph (provided due to Ibid. § 10-4-114) will also be changed to conform with that of the first paragraph (both will be in second person).
- Anti-Coercion Insurance Disclosure (Cx2778), Idaho Version: References to “the lender” will generally be changed to “a person,” effectively disclosing that no person shall unreasonably disapprove of the borrower’s choice of insurer. This will align the language of the disclosure closer to that of Idaho Code §§ 41-1310 & 41-1312.
- Anti-Coercion Insurance Disclosure (Cx2788), Arizona Version: References to “the lender” will generally be changed to “a person,” for the same reasons as described above. Also, the citations on this form will be revised to match Blue Book standards (Ariz. Rev. Stat. Ann. §§ 6-909(P), 6-947(O), 6-991.02(L), 20-452.01, & 20-452.02).
- Anti-Coercion Insurance Disclosure (Cx2788), Nevada Version: References to “the lender” will generally be changed to “a person,” for the same reasons as described above. The citations on this document will also be revised to match Blue Book standards (Nev. Rev. Stat. §§ 598D.100(1), 686A.200, & 691A.030).
