Cx13568 has been provided for the past several years due to the provisions of Wash. Rev. Code Ann. §§ 26.60.010 through 26.60.901 (West 2012) concerning domestic partnerships. In addition to Cx13568, we have also been providing a multi-state “Addendum to Loan Application” (Cx13441), which was also created to fulfill the same provisions of Washington’s law, as well as Ibid. §§ 26.04.010 through 26.04.900 (West 2012) concerning same-sex marriages (more details on these sections below).
These documents are provided for the benefit of mortgage lenders. They explain to the loan applicants that due to state law, a domestic partner or spouse may have a vested ownership interest in the subject property and allow for the borrower to indicate whether someone other than themselves has such an interest.
Since these documents are, on a legal basis, substantially similar, and in order to streamline the disclosure process, we will discontinue providing and maintaining Cx13568 as a generic document on the effective date set forth below. However, since in form it is different than Cx13568, it will be available upon request for any clients who would like to use it.
Cx13441 may also undergo some substantive changes later this next week, depending on the outcome of 2012 Wash. Legis. Serv. Referendum 74 which will be voted upon on November 6, 2012 by Washington State voters. This Referendum came into being due to the provisions of 2012 Wash. Legis. Serv. ch. 3 [S.B. 6239], which was passed earlier this year amending these sections to generally allow for same-sex marriage and domestic partnerships. If the Referendum is approved, the provisions concerning same-sex marriage and domestic partnerships will be enacted. If not, these provisions will not be enacted.
We will make any necessary changes to Cx13441 depending on the outcome of this election and will post an announcement concerning these changes before they take effect.
