Unlike most disclosures, which are required by either a statutory or administrative law, Cx13569 is required by enacted legislation that has not been codified (2008 Me. Legis. Serv. 687, § 2 [West]).
This legislation requires the Department of Administrative and Financial Services, Bureau of Revenue Services to prepare a “guidance document” which real estate agents, real estate lenders, settlement agents, and any other person and entity involved in the transfer of real estate are requested to give to both sellers and buyers “at any point in the process of the transfer of property when the allocation of property taxes is discussed and with any notices relating to property tax liens.”
The Bureau of Revenue Services provides a copy of this guidance document and also the legislation on their website. We will be updating Cx13569 to exactly match the language of the guidance document published by the website, which has two additional words (“tax lien”) in the last paragraph than the form of the document in the legislation.
