California Senate Bill 1050 (http://leginfo.legislature.ca.gov/faces/billStatusClient.xhtml) was enacted on August 15, 2014 and becomes effective on January 1, 2015. CA SB 1050 amends Section 1189 of the California Civil Code and Section 8202 of the California Government Code, which impacts the formatting of notarial certificates by requiring a box directly above acknowledgments and jurats containing the following text:
“A notary public or other officer completing this certificate verifies only the identity of the individual who signed the document to which this certificate is attached, and not the truthfulness, accuracy, or validity of that document.”
Cal. Civ. Code § 1189(a)(1) & Cal. Gov. Code § 8202(b).
All generic ConformX documents containing California acknowledgments and jurats have been updated in conformance with CA SB 1050. Changes to any custom documents containing California acknowledgments and jurats will be made upon request.
Please note that DocuTech received communication from the California Notary Public & Special Filings Section as follows:
“Some counties have recommended that the language in the box not be used until January 1; therefore, using the box earlier than January 1 may cause a document to be rejected.”
