Document Updates: TX Disclosure Statement Required for Residential Construction (Cx4262)

Texas Property Code §53.255(a) requires that, before executing a residential construction contract, the original contractor must deliver a disclosure statement to the property owner. Subsection (b) provides the statutory language that must be included in the disclosure.

Following an audit of this document, we made minor updates to Cx4262. Most of the revisions involved replacing terms such as “retainage” and “withholding” with language that more closely aligns with the statute, such as “statutory reserve” and “reservation.”
