Document Updates: Nebraska Requests for Notice of Default (Cx496 and Cx3044)

Nebraska Revised Statute § 76-1008 provides a model Request for Notice of Default which identifies the applicable trust deed by, among other information, the date it was filed for record and its book and page or computer system reference.

We have updated the Request for Notice of Default language in the following documents:

• Cx496 NE Deed of Trust Second

• Cx3044 HELOC Deed of Trust – NE

Previously, the first recording-information blank in the request populated with the prior lien’s recording instrument/entry number. This field has been replaced with the First Lien Recording Date so that the request more closely follows the statutory model form.

We have also added a Borrower signature line directly beneath the Request for Notice of Default on Cx3044. The signature line will print when the Request for Notice of Default prints. This change aligns Cx3044 more closely with the statutory model form and with the existing treatment on Cx496.

These changes are available for testing on Stage & Stage 2 servers and will take effect on [effective date]. If you have any questions or concerns, please contact Client Support at 1.800.497.3584.
