Document Updates: Tennessee and West Virginia Security Instrument Residency Logic (Various Documents)

Tennessee and West Virginia are trustee states that require the named trustee to be a resident of the state. See Tenn. Code Ann. § 66-24-1323 and W. Va. Code § 38-1A-2. Both jurisdictions permit disclosure of the trustee’s county of residence as sufficient to satisfy this requirement, consistent with FNMA model instruments.

We are implementing a refinement to the data population logic used for trustee residency disclosure on the security instrument:

  • The system will continue to populate trustee residency using Field 2014 (“Trustee Resident Of”) when available. This will be handled by updating the global prompt on FI 2014 to always prompt for TN and WV Closings when FI 2014 is empty.
  • If Field 2014 is not populated, the system will now default to Field 1278 (“Property County”).

This update is intended to ensure that a valid county-level residency disclosure is consistently included on the instrument, even when explicit trustee residency information is not provided.

The following instruments have been updated with the new logic:

  • Cx1389 – HELOC TN Deed of Trust

  • Cx25321 – 3043 TN Deed of Trust (2021)

  • Cx26160 – FHA TN Deed of Trust (2021)

  • Cx509 – TN Deed of Trust Second

  • Cx3045 – HELOC Deed of Trust – WV
