Upon review of the Georgia Seller’s Certificate of Exemption (our Cx1010), Docutech has determined that an update is in order. Ga. Code Ann. § 48-7-128 allows for an exemption for withholding requirements upon sale or transfer of real property to nonresidents. Docutech has updated its Cx1010 to match the model form as provided by the GA Department of Revenue. The change modifies the revision number of the document and adds a statement “For taxable years of the seller beginning on or after 1-1-2022, the seller qualified for and has made or intends to make the election to be taxed at the entity level as provided by O.C.G.A Section 48-7-21 or 48-7-23.”
